You can use this form to

Apply for a permit to trade on Council land directly outside your business. The items are required to be removed from Council land at the end of each trading day.

You must submit your application at least 4 weeks before you plan to commence footpath trading, to allow for:
- Assessment of your application.
- Payment of your invoice if your application is successful.
- Permit issued before footpath trading commences.

To complete this form

It takes 10 minutes to complete this form and you will need to:
- Tell us your name, address, email address and phone number.
- Provide the proposed hours of operation and details of any advertising signage
- Upload copies of the following documents:
  - Trading zone map
  - Current business registration certificate
  - Certificate of Public Liability Insurance for a minimum of $20 million, noting the interest of City of Boroondara as an insured party
  - Site plan showing the proposed location of the footpath dimensions and position of local infrastructure
  - Picture and dimensions of proposed furniture
  - Current registration to serve food and/or beverages under the Food Act 1984
  - Letter from neighbouring property if seeking to trade in front of neighbouring business

We will:
- Send you an email confirming we have received your application.
- Assess your application. We will be in contact with you to confirm details or request documentation as needed.
If successful, we will issue you with a permit for footpath trading.

What happens with your information?

We record your information on our customer database and make it available to relevant Council staff in line with City of Boroondara’s Privacy Statement.

The contact details you provide to Council may be used by Council to contact you in relation to other Council functions and services.

The owner, in signing this application form, agrees to comply with permit conditions & guidelines and to indemnify the Council from and against any loss, damage or expense (including legal costs) arising from any claim, demand, action, suit or proceeding that may be brought by any person againstthe Council in respect of the death or injury of any person or the loss or damage to any property, where such death, injury, loss or damage arises out of or inconnection with the owner’s actions on any land owned or managed by the Council and is caused by the negligent act or omission of the owner or the owner’semployee,agent,contractor or client. PROVIDED THAT the owner shall not be liable for any liability or loss to the extent that such lossor damage is caused by the error, omissions or actions of the Council. Where negligence is found to have been contributory, each party shall bear full responsibility in accordance with the party’s fault.
